  Suffix	Jr.
  Birth	1983
  Gender	Male
  Death	20 Oct 2004
Michael Holz, 26, fatally stabbed Nathan Naibert when he found him in bed with his ex-girlfriend. Michael’s ex-girlfriend was woken up to find him standing in her bedroom, yelling at her and Nathan that they both deserved to die and he was going to be the one to kill them. Michael got a knife from the kitchen and stabbed Nathan in the right side of his chest, severing his pulmonary artery. He then put the knife in the bedroom door. While Michael’s exgirlfriend was on the phone getting medical advice from the 911 dispatcher, Michael stabbed her in the back. She went back into the bedroom, locked the door and waited for help. Michael’s ex-girlfriend and Nathan, who lived together as friends at the time of the murder, had dated previously. Michael was unwilling to accept the breakup with his exgirlfriend and thought the two of them could “work things out”. Michael Holz was charged with First Degree Intentional Homicide and Attempted First Degree Intentional Homicide and pled guilty to a lesser charge of Second Degree Intentional Homicide and Attempted Homicide. He was sentenced to 45 years in prison and 20 years extended supervision for both charges. 2004 Wisconsin Domestic Violence Homicide Reporthttps://endabusewi.org/wp-content/uploads/2018/11/2004_dv_homicide_report.pdf GREEN BAY, Wis.—A man convicted of stabbing a man to death and wounding his former girlfriend after finding the two in bed is seeking a new trial, saying he got bad advice from his lawyer. Michael Holz, now 29, pleaded no contest to charges of second-degree intentional homicide and attempted first-degree intentional homicide in the Oct. 20, 2004, fatal stabbing of Nathan Naibert, 21, and wounding of Faith Dempsey. He is serving a 45-year prison sentence. Holz, from Green Bay, has filed a motion in Brown County Circuit Court to withdraw his no contest pleas, saying he got bad advice about whether he was entitled to appeal pretrial decisions about the admission of psychiatrists’ expert opinions. Holz claims trial lawyer Scott Wales told him that he could appeal on those grounds. But Wisconsin law dictates that a defendant gives up those rights with a no contest or guilty plea. Wales took the witness stand during a hearing Tuesday and admitted he gave Holz incorrect information. Under cross-examination, Wales said he did not remember the exact words he used or the specifics of the conversation but was certain he told Holz he could appeal. Holz’s current attorneys contend Wisconsin case law allows Holz to withdraw his pleas because he did not make them voluntarily or intelligently because they were based on bad legal advice. Brown County Deputy District Attorney John Luetscher argued that Holz’s conversations were likely more focused on the ramifications of the plea agreement reached in the case than an evidence issue. Dempsey died from a drug overdose Feb. 16 at the age of 25. If a new trial is held in Holz’s case, officials would have to find a way to offer jurors information from Dempsey, but that would not be an insurmountable hurdle, Luetscher said. Lawyers agreed to file written arguments on the matter by Jan. 25, and Judge Kendall Kelley said he would rule Feb. 8. ——— Information from: Green Bay Press-Gazette, http://www.greenbaypressgazette.com Originally Published: December 19, 2007 at 12:38 PM CST
